1. Agreement
Ember is operated by StableModels LLC, a North Carolina limited liability company ("Ember", "we", "us"). These Terms govern your use of Ember — the builder at embersites.app, this site, our APIs and command-line tools, and the hosting of sites you publish (the "Service").
By creating an account, starting a build, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. If you're using Ember for an organisation, you confirm you can bind it, and "you" means that organisation.
2. Accounts and eligibility
Ember is offered only to customers in the United States. By using the Service you represent that you are located in the United States and, if you're using it for an organisation, that the organisation is established in the United States. We don't market Ember outside the US, and we may decline or close an account we believe is outside it.
Ember is built to one country's rules. We do not offer GDPR, UK GDPR, or other non-US regulatory features — no data processing addendum, no standard contractual clauses, no data-residency guarantees, no EU representative, and no undertaking to support data-subject procedures that exist under non-US law. If your use of Ember requires any of that, don't use it.
You must be 18 or older. One person or organisation is responsible for each account — including everything done by any team member you invite, and the bill. You sign in with Google or with an email address and password; anyone controlling that Google account, that inbox, or that password can sign in as you, so keep them secure and tell us if they're compromised.
3. Acceptable use
Don't use Ember, or publish a site with it, for any of the following:
- Anything illegal, or that facilitates illegal activity.
- Phishing, credential harvesting, or deceptive lookalike sites.
- Malware, exploits, or anything designed to damage or gain unauthorised access to a system.
- Spam — bulk unsolicited messaging, doorway pages, link farms, scraped-content churn.
- Impersonating a person or organisation, or misrepresenting your affiliation.
- Content you don't have the rights to, or that infringes copyright, trademark, privacy, or publicity rights.
- Child sexual abuse material, content sexualising minors, or non-consensual intimate imagery.
- Harassment, threats, incitement to violence, or content promoting self-harm.
- Probing or circumventing the Service's limits, gates, or security; reselling capacity; automated abuse of the free tier.
We may suspend an account, unpublish or remove a site, or remove content at any time if we reasonably believe these rules have been broken, if we're required to by law, or if content creates risk for others or for the Service. We'll tell you why where it's practical and lawful to do so, but we may act immediately and without notice.
4. Copyright complaints
If you believe content published through Ember infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent at support@embersites.com. Include the work you claim is infringed, the URL of the material, your contact details, a statement that you have a good-faith belief the use is unauthorised, a statement under penalty of perjury that your notice is accurate and you are authorised to act, and your signature. We remove or disable properly noticed material promptly, and we'll pass the notice on to the customer, who may submit a counter-notice.
We terminate the accounts of repeat infringers. Material misrepresentations in a notice or counter-notice carry liability under 17 U.S.C. § 512(f).
5. Your content
You own your content — everything you bring to Ember or create with it. Nothing here transfers that to us.
To run the Service you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, back up, transmit, compile, render, cache, and publicly display your content, and to make the technical changes needed to do so, for as long as you keep it on Ember. It ends when you delete the content or close your account, except for backups and logs that age out normally. Any feedback you give us about Ember, we can use freely.
Published sites are public. Anyone on the internet can visit them, and third parties we don't control can crawl, index, archive, and copy them. Unpublishing stops us serving the site; it can't retrieve copies made elsewhere. Don't publish secrets, credentials, or other people's personal information.
You're responsible for having the rights to everything you upload or import, for what your published site says, and for any legal notices your own site needs — including its own privacy policy if it collects anything from your visitors.
6. AI-generated output
Ember builds your site with large language models. Before you publish, understand that:
- Output can be wrong. Models produce confident text and code that is sometimes inaccurate, out of date, or invented. We warrant nothing about its accuracy, completeness, or fitness for any purpose.
- Output may not be original. Similar prompts produce similar results, and generated text, layout, or imagery may resemble existing work. We don't warrant originality or non-infringement.
- Reviewing what you publish is your responsibility — facts, prices, claims, contact details, and anything touching health, finance, safety, or law.
- The agent gathers current information while you chat and writes it into the page as fixed content. A published site shows what was true when it was built; it does not refresh itself.
As between you and us, the output is yours to the extent it can be owned. In some jurisdictions purely machine-generated material attracts no copyright at all — that's a matter of law, not something we can grant.
7. Plans, billing, and credits
Plans and current prices are on our pricing page. Paid plans are billed monthly in advance in US dollars and renew automatically every month at the then-current price until you cancel. Cancel any time from Account settings → Billing; cancellation takes effect at the end of the current billing period.
- Upgrades take effect immediately, and we charge the difference for the rest of the period.
- Downgrades and cancellations take effect at the end of the current billing period. You keep the tier you paid for, and the credits granted for it, until then.
Credits
Ember meters work in credits — building and editing, image generation, web research. Credits are a unit of account for using the Service. They are not money, have no cash value, are not transferable or redeemable for cash, and are non-refundable.
- Plan credits are your plan's monthly allowance. They reset at the start of each billing cycle and do not roll over.
- Top-up credits are bought separately and roll over indefinitely, surviving cycles, plan changes, and cancellation.
- Spending draws on plan credits first, then top-ups. We may change what an operation costs as our costs change.
No refunds
Payments to Ember are non-refundable. Our cost of serving the Service is incurred as you use it, so we don't refund unused time, unused or consumed credits, a period already paid for, or domain registrations — including when you downgrade or cancel mid-period. The remedy is to cancel, which stops future billing. Nothing here overrides a refund right you have under a law that applies to you and can't be waived.
Payments and taxes
Payments are processed by Stripe; Ember never receives or stores your card details. Prices exclude taxes unless stated, and we'll add any we're required to collect. If a payment fails we may retry it and suspend paid features, including publishing, until it succeeds. We may change prices — a change to an existing subscription takes effect at your next renewal after notice under section 11, so you always have a period in which to cancel first.
8. Domain registrations
Read this before you buy — a domain bought through Ember is not held the way you may expect.
Ember registers domains through Cloudflare Registrar, as a reseller. Under section 1.3 of Cloudflare's Domain Registration Agreement, Ember is the holder of record and registrant of the domain, and you are its licensee — the registration is in our name, and you hold the right to use and control that domain through Ember while it is registered and your account is in good standing. You do not obtain outright ownership of the registration by buying it here. We won't use the domain for anything but your site, and we'll act on a reasonable transfer-out request from the account that bought it.
Section 1.3 requires us to pass the applicable Cloudflare terms through to you. By registering a domain through Ember you agree to be bound by the Cloudflare Domain Registration Agreement as if you were the registrant, together with ICANN's Registrant Rights and Responsibilities and your domain extension's registry policies. Those documents are incorporated into these Terms by reference and control over these Terms for anything to do with a domain registration.
- Registrations are final and non-refundable once complete. We charge your card before we register, so a declined payment stops the purchase before it becomes irreversible; if the registry then fails the registration, we cancel and refund that charge.
- ICANN's 60-day transfer lock applies after registration and after certain contact changes.
- Transferring out is a manual, support-assisted process today. Once the lock has passed, email support@embersites.com.
- Domains auto-renew annually at Ember's then-current retail price — the wholesale registry fee plus a flat yearly margin — billed as its own annual subscription. Registries change their fees, so the renewal price can change year to year; the current price is shown before you buy and on your invoices.
- We manage the domain's DNS in Ember's own Cloudflare account. You don't get registrar or DNS panel access; tell us the records you need.
- Cancelling your plan or detaching the domain from a site does not cancel the domain. The registration and its annual billing keep running, and you keep the domain. Cancel that domain's subscription in your billing settings or ask support — a deliberate, separate action, so a lapsed plan can never silently cost you a domain name.
- ICANN requires accurate registrant contact details; false or unreachable details can get the domain suspended. Domains are subject to registry and ICANN dispute policies (including the UDRP), and we may act on a registry, ICANN, or court order affecting one.
9. Availability and changes to the Service
Self-serve plans carry no service level agreement and no uptime guarantee, and the Service is provided on an as-available basis. We may perform maintenance, and may add, change, or remove features at any time. If we make a materially adverse change to a paid plan, we'll give notice under section 11 so you can cancel before your next renewal. Beta features may change or disappear without notice. Ember depends on third-party infrastructure and AI providers (listed on our Service Providers page); we're not responsible for their availability.
10. Termination
You can cancel any time from your billing settings, delete individual sites, or ask us to close your account. We may suspend or terminate your account if you breach these Terms, if payment fails and stays unpaid, if we're required to by law, or if continuing would expose us or others to material risk — with notice where practical. We may discontinue the Service as a whole on 30 days' notice.
- Cancelling a paid plan reverts you to the free tier at the end of the paid period. Published sites are unpublished (publishing requires a paid plan); your content stays and you can keep building and previewing.
- Closing or terminating an account: we keep your sites and content for 30 days so you can retrieve them, then delete them permanently. For severe abuse — illegal content in particular — we may remove content immediately with no retention period.
- Export before you close. Download your site's source files from the builder's file browser or the
embercommand-line tool while your account is open. We can't promise to recover anything after the retention window closes. - Domains you registered through Ember are not deleted with your account. Contact support before closing so we can transfer or cancel them deliberately.
Sections 5, 7 (no refunds), 11, 12, and 13 survive termination, along with anything else that by its nature should.
11. Disclaimers, liability, and indemnity
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or trade usage. We don't warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated output will be accurate, original, or suitable for your purpose.
Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, even if advised such damages were possible.
Our total aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the amounts you paid us in the 6 months before the event giving rise to the claim and (b) US$50.
Any claim must be brought within one year of the event giving rise to it, or it is permanently barred.
You'll defend and indemnify us — StableModels LLC and its members, officers, employees, and agents — against any third-party claim, loss, liability, or cost (including reasonable legal fees) arising from your content, your published site, your use of the Service, your breach of these Terms or of any law, or your infringement of anyone's rights. We'll notify you promptly and give you control of the defence; you may not settle in a way that admits our fault or binds us without our consent.
Where a jurisdiction doesn't allow one of these exclusions or limits, it applies to the maximum extent permitted. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that can't lawfully be limited. These allocations of risk are a fundamental part of the bargain and the reason the Service is priced as it is.
12. Changes to these Terms
We may update these Terms, and will change the date at the top when we do. For material changes — anything that meaningfully reduces your rights or increases your obligations, including a price increase on an existing subscription — we'll give at least 30 days' notice by email to the address on your account or in the product. Continuing to use Ember after the stated date means you accept them; if you don't, cancel before then. Clarifications and corrections take effect when published.
13. General
Governing law and venue. These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules, and you and we submit to the exclusive jurisdiction of the state and federal courts in North Carolina. Either party may still seek injunctive relief anywhere to protect its intellectual property or confidential information.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service; for domain registrations the terms incorporated in section 8 apply in addition. Severability and waiver: an unenforceable provision is narrowed to the minimum needed or severed, and the rest stands; not enforcing a provision doesn't waive it. Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or in a merger or sale of substantially all our assets. Notices: notices to you go to the email address on your account — keep it current — and all notices to us, including legal notices, go to support@embersites.com, which both parties accept as valid written notice.
